Officers responded to a call regarding a stolen truck in a trailer park. The officers then contacted Mr. J.P. at his doorway of his trailer to investigate the matter. Pursuant to a “protective sweep” the officers entered the trailer of Mr. J.P. and found a loaded handgun in plain view. Mr. J.P. had a prior felony conviction and his rights to possess a weapon had not been restored and he was therefore a “prohibited possessor”.
Attorney Chris Flores filed a Motion to Suppress the evidence obtained in violation of Mr. J.P.’s Fourth Amendment Rights of a warrantless search. Prior to the argument on the motion, the State dismissed the charges.
