Mr. C.B. was being treated at a hospital for an apparent over intoxication. The attending nurse checked Mr. C.B.’s pockets for identification and found what appeared to be cocaine. The nurse placed the contraband back into the pocket and called authorities. When the investigating officer arrived he retrieved the suspected contraband from the pocket without a warrant. Attorney Chris Flores filed and argued a motion to suppress the evidence in violation of the Defendant’s Fourth Amendment Right against a warrantless search. The court found that the officer did violate the law when he retrieved the property from Mr. C.B.’s pocket without a warrant and suppressed the evidence. Without the evidence the State could not proceed to trial and the case was dismissed.
