Mr. F. H-R. was alleged to have been a courier and helper in a large Drug Trafficking Organization. Numerous telephonic wire taps were used over the course of months to record phone calls related to the illegal business of the organization. The State used the recorded phone calls to secure an indictment against 12 individuals of the organization. All of the co-defendants except Mr. H-R and one other co-defendant rejected State’s plea offers and elected to go to trial. One week before trial the case was dismissed based on the State’s failure to complete an application for wiretap approval as required by law.
